General Terms And Conditions of Business

Pikajob
Gomobee LTD
Mindo, 113, Mdina Road, Qormi, QRM 9016, Malta

1. General

1.1 By ordering a paid service, you accept the following provisions. They describe the conditions for using the mobile data services and digital content offered by Gomobee LTD, Mindo, 113, Mdina Road, Qormi, QRM 9016, Malta (collectively “Products”), including the Pikajob service, via the Internet, WAP, SMS, MMS or other usage technologies on your mobile device.

1.2 If we change these Terms and Conditions to your disadvantage, we will notify you of those changes on our website and electronically. The changes will be deemed approved if you do not object within one month of receipt of the notification. We will remind you of this right of objection in our change notification. If you object, the contract will continue under the previous conditions.

1.3 If, in response to your objection, we inform you that it is not possible to continue under the previous conditions, you can terminate the contract for the respective service within one month of receiving this notice, unless shorter statutory notice periods apply. The amended Terms will be deemed approved if you do not exercise this right to terminate. We will draw your attention to this consequence in the notification. If prices are adjusted to your disadvantage due to an increase in VAT, you are not entitled to object.

1.4 We or the third party calculate VAT at the rate applicable at the time the service is provided.

2. Service Description and Provision of the Products

2.1 Pikajob is a subscription service that gives users access to new job offers, daily career news and AI tools to help them get hired faster. Users can browse job offers, read career news and use the AI tools for the duration of their subscription.

2.2 Gomobee LTD offers various products for downloading, displaying and using on mobile devices, in particular mobile phones, smartphones and tablets as well as PCs. These are products from our own production as well as licensed products from third parties. The provider has no influence on the content of third-party licensed products. No editorial review or processing by the provider takes place. Gomobee LTD assumes no liability for the topicality, completeness or correctness of the information and digital content transmitted within the scope of the services, or for their timely and error-free technical transmission.

2.3 The user can access some products free of charge after registration. Other Products are chargeable. The usual connection tariffs of the connection provider, e.g. the Internet or mobile phone provider, apply for access to the various offers. For large-volume data transmissions, we recommend a flat-rate data tariff with your mobile phone provider or using WLAN to keep data transmission costs as low as possible.

2.4 [NEW] Job offers shown in Pikajob are published by third-party employers or sources. The provider does not verify each offer, is not a party to any employment relationship, and does not guarantee interviews, job placement or employment. Results from the AI tools are suggestions only, and the user is responsible for reviewing them before use.

3. Conclusion of Contract

3.1 The provider offers various procedures for ordering products. These are described with each product on the Internet, in printed brochures, in WAP, on TV or in other media.

3.2 To subscribe to Pikajob, enter your mobile number on the service page, then:
Sunrise users: reply OK to the SMS received.
Salt users: enter the PIN received on your mobile.
Then click CONTINUE to access Pikajob Premium.

3.3 Chargeable products can be purchased as a single purchase or as a continuing obligation in the form of subscriptions. Subscriptions can include a specified number of vouchers or credits. These entitle you to download, use, receive or access the products to the extent specified in the product description per billing period. The type and number of vouchers depend on the selected subscription model (weekly or monthly). Info services can consist of a regular dispatch of information (e.g. daily career news) or an event-based dispatch of information (e.g. new job offer alerts). The provider has no influence on the maximum amount of information for event-based services. Complimentary products can be granted as an extra with a single purchase or subscription, or offered independently.

3.4 By requesting a product from a subscription offer or as a single purchase, the user makes a binding offer to use the selected product at the current price. A contract between the provider and the user (hereinafter “contract”) is concluded when the provider accepts the offer by a) sending the product, or the first product from a subscribed category, to the user (e.g. an SMS info message) or a license key, b) enabling the user to download the product (e.g. by sending a WAP push link or download PIN), or c) activating access to the product for the user (e.g. by activating the MSISDN for this product).

3.5 If the user purchases a provider product that is not sold via electronic media, directly or through third parties, a contract based on these Terms is concluded at the time the product is purchased from the retailer.

3.6 Unless a fixed term has been agreed, the term of a subscription is based on the billing period the user was informed of when placing the order. After each billing period, the subscription is extended by a further billing period and remains in effect until terminated in accordance with Section 7.

3.7 Vouchers and download, reception and access options are offered at a weekly or monthly total price, depending on the subscription model. This total price is due regardless of whether and how the customer uses the offer, in particular if the vouchers granted are not used or not used in full. Activating access or enabling downloads or use fulfils the provider’s contractual obligation. The user decides when and how the content is actually accessed. Vouchers are reduced by actual downloads. Depending on the subscription model, unused vouchers either carry over to the next billing period until used or until the subscription ends, or they expire at the end of the relevant billing period. If the customer exceeds the number of vouchers available for a billing period, they will pay for additional downloads at the retail price specified for the relevant products.

3.8 The subscription offers are subject to change. We reserve the right to extend or restrict content and prices, even for ongoing subscriptions, e.g. if the costs for content, services or transport increase. For price and offer changes, Section 1.2 applies accordingly. Vouchers can only be redeemed for provider products.

3.9 Changes to or restrictions on the provider’s services have no effect on the user’s contract with their mobile phone provider.

3.10 The provider reserves the right to reject abusive user requests.

4. Rights and Obligations of the User

4.1 The user must provide the required information truthfully and completely when registering, and must update it immediately if changes occur.

4.2 Only the registered user is personally entitled to use the provider’s products via their user account and may not allow other people to use it. The user must keep passwords, PINs etc. secret and not pass them on to third parties. As soon as the user becomes aware that third parties have had access to the password, they must immediately block their account by emailing customer service at pikajob.ch@silverlines.info. Unless the access or disclosure is due to the fault of the provider, the user bears the costs of products retrieved up to the time the account is blocked.

4.3 All products of the provider are protected by copyright and trademark law. The user is entitled to save the products on their mobile phone. Any other storage, in particular transfer to another mobile phone, is not permitted. Copying, duplication or further processing of the products is also not permitted.

4.4 The user must use all content received via the products exclusively for personal and private use, unless otherwise agreed in individual cases.

4.5 If the user can send, upload or publish content via the services (including CVs, cover letters and profile information), the user is responsible for the legality, accuracy and youth protection compliance of this content. It is expressly forbidden to send content that violates criminal law, touches on other illegal or immoral topics (e.g. content glorifying violence, sexist, racist, pornographic or extremist content), or refers to publications with such topics. If such violations occur, the provider reserves the right to stop the services without further notice and remove the content.

4.6 Commercial use of the products is only permitted with the prior written consent of the provider.

5. Limitation of Liability

5.1 The provider is liable for damages caused by intentional and grossly negligent conduct of its own organs and vicarious agents, and for damage resulting from injury to life, limb or health, regardless of the degree of fault. The provider is also liable for slight negligence of its organs and vicarious agents in the event of impossibility, delay in performance, non-compliance with a guarantee, or breach of another essential contractual obligation. Essential contractual obligations are those that make execution of the contract possible and that you can regularly rely on. In the event of a slightly negligent breach of these obligations, liability is limited to damage typical for the contract that the provider could reasonably foresee when the contract was concluded. Any further liability is excluded. These limitations also apply in favor of the provider’s organs and vicarious agents. Claims under mandatory product liability law remain unaffected.

5.2 These limitations do not apply to damage resulting from injury to life, limb or health based on breaches of duty by the provider, its legal representatives or vicarious agents, or where mandatory statutory regulations apply.

5.3 The provider aims to deliver current information and requested products as quickly as possible. The provider relies on third-party services and distribution channels whose availability it cannot control, so it does not guarantee delay-free transmission. The provider is not liable for temporary or permanent interruption of data transmission unless it is responsible for the cause. It is also not liable for the constant availability of the services, e.g. in the event of a failure of the transport provider. The provider reserves the right to temporarily interrupt the services for maintenance or technical reasons.

5.4 The provider uses hyperlinks to WAP and websites over whose content and design it has no influence. The provider assumes no liability for the form and content of linked pages, including job offers published on third-party sites. If the provider becomes aware that linked pages or content posted by users violate applicable law, it will remove the hyperlink or content after examining the situation.

5.5 Using the products may require technical systems such as end devices, software, transmission paths, telecommunications and other third-party services. These may incur additional costs for the user, in particular connection fees, which the user pays separately. The provider does not supply these and assumes no guarantee or liability for them.

6. Fees

6.1 Pikajob costs CHF 15.00 per week, charged as follows:
Sunrise: 1 SMS x CHF 15.00 per week
Salt: 3 SMS x CHF 5.00 per week
The standard MO message rate depends on the user’s tariff plan.

6.2 The provider offers different payment options depending on the product and ordering method, including billing via the mobile phone bill, prepaid credit, or a third-party payment system. Payment options are explained when ordering. Credit and vouchers on the provider user account can only be redeemed for provider products. Current final prices, including VAT and any additional costs, are stated with the corresponding product and ordering method.

6.3 Using the products may require third-party services or user accounts with third-party payment systems. These may result in additional costs, in particular connection fees, payable by the user to the respective third party. For extensive downloads, we recommend a data option for your mobile device or using WiFi.

7. Termination

7.1 Either party can terminate at any time without giving reasons. The user can cancel the Pikajob subscription by sending an SMS with the keyword STOP to 995. The user can also terminate in writing to Gomobee LTD, Mindo, 113, Mdina Road, Qormi, QRM 9016, Malta, by email at pikajob.ch@silverlines.info, or by calling the hotline at +41445816440. If no minimum term has been agreed, termination takes effect immediately. If a minimum term has been agreed, termination takes effect at the end of the minimum term.

7.2 The provider can terminate a subscription without notice if the user misuses products or uses them in violation of essential obligations, in particular under Section 4, violates common decency or applicable law, or violates the rights of third parties. It can also be terminated extraordinarily if:
(a) the user stops making payments or does not pay outstanding amounts without reason after default,
(b) the user seeks a debt moratorium with their creditors,
(c) debt enforcement or insolvency proceedings are opened against the user, or there is another significant deterioration in the user’s financial situation, unless the user provides an appropriate security deposit within 10 days of a request,
(d) the user defaults on due invoice amounts and continuing the contract is unreasonable.
With extraordinary termination, all claims from the contract become due immediately and the user account will be blocked. The user must compensate the provider for all damage caused by the misconduct that led to termination and indemnify the provider against third-party claims, including legal costs.

8. Privacy and Use of Data

8.1 The provider is entitled to collect, process and use the data received from the user and data arising from use of the service, in accordance with statutory provisions, to the extent necessary for running the service and processing the contract. If services are provided by or contracted with a third party, the provider is entitled and obliged, within legal requirements, to transfer the data needed for contract fulfilment and billing to that party. This is mainly your customer number, mobile phone number, time of use and the price to be paid. The provider will not transmit any inventory, connection or content data to third parties without your express consent unless legally entitled or obliged to do so.

8.2 When processing data and providing the service, the provider will observe telecommunications secrecy, the Swiss Federal Act on Data Protection (FADP), the EU General Data Protection Regulation (GDPR) where applicable, the Swiss Telecommunications Act (TCA), and other relevant data protection laws.

8.3 [NEW] If the user uploads a CV or other personal documents to use the AI tools, the provider processes this data only to deliver the requested feature (e.g. CV analysis or improvement). The provider will not share CVs with employers or other third parties without the user’s express consent. The user can request deletion of uploaded data at any time by emailing pikajob.ch@silverlines.info.

9. Protection of Minors

Users must be 18 years of age or have permission from a parent or the mobile phone owner to use the service. The provider attaches great importance to youth protection. Access to content harmful to young people, or offers only suitable for adults, is only possible after prior age verification within a closed user group. Customers who cannot identify or authenticate themselves cannot be granted access. Request messages that do not lead to product delivery due to youth protection rules must still be paid for. The provider assumes no liability for the correctness of identification carried out outside its sphere, or if false identification documents are presented or identity is otherwise concealed.

10. Governing Law and Jurisdiction

10.1 All legal relationships between the provider and the user are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions remain unaffected.

10.2 If the user is a business or a public law entity, Zurich is agreed as the exclusive place of jurisdiction for all disputes arising from these Terms.
